The defendant was indicted and convicted for theft in the second degree. Alabama Code 1975, Section 13A-8-4.

The indictment, in pertinent part, charges as follows:

"Sarah Garner, ... did obtain by deception, control of, to-wit, food stamps valued at to-wit $222.00 in U.S. currency, the property of the State of Alabama, said deception being as follows, to-wit: the said Sarah Garner created a false impression or failed to correct, while...
