This is an appeal from an order of Judge James T. Foley of the Northern District of New York dismissing plaintiff's pro se civil rights complaint. Plaintiff alleged that while he was a prisoner at Auburn Correctional Facility he was wrongfully beaten and confined in a Special Housing Unit (SHU) for which he demanded damages as well as declaratory and equitable relief.
