DODSON, Justice.

Brian Dean Kirkham, the appellant, was charged by complaint and information with the offense of driving a motor vehicle while under the influence of intoxicating liquor. The jury convicted the appellant of the offense charged, assessed his punishment at three months in jail and a fine of $150.00, and recommended that the jail time and fine be probated.
