Defendant appeals the denial of his motion to dismiss a felony theft charge based on a contention that to pursue the case would constitute double jeopardy under the Fifth Amendment to the United States Constitution.

The appellant was being tried by a jury for the offense charged, when the arresting officer testified that after the Miranda warning had been given to the appellant, the latter stated that he "didn't want to make a statement...
