This litigation was brought to test, inter alia, the use of the California Achievement Test (CAT) as an exit examination. After trial, the Court was inclined, applying the rational relation test to the use of the CAT, to hold that no substantive due process violation had occurred. In the meantime, however, while the matter was under advisement, the Fifth Circuit handed down its decision in Debra P. v. Turlington...
