Defendant Darren Hooks was charged on September 18, 1980, by a Grand Jury indictment with first degree murder while in the perpetration of aggravated rape, a violation of LSA-R.S. 14:30, committed on August 26, 1980. Defendant entered a plea of not guilty and in May, 1981, he was tried before a twelve member jury and found guilty as charged. The jury was unable to agree upon a sentencing recommendation...
