BOOKER CREEK PRESERVATION, INC., Appellant, v. STATE of Florida, DEPARTMENT OF ENVIRONMENTAL REGULATION, Appellee.

District Court of Appeal of Florida, First District.

Rehearing Denied July 9, 1982.

Attorney(s) appearing for the Case

Thomas W. Reese, St. Petersburg, for appellant.

Mary F. Clark, General Counsel for Dept. of Environmental Regulation, Tallahassee, for appellee.

PER CURIAM.

While we find that appellant had standing to maintain this rule-challenge, Florida Home Builders Ass'n v. Department of Labor and Employment Security, 412 So.2d 351 (Fla. 1982), we find no error on the merits of the hearing officer's decision that the rule challenged was lawfully adopted.

AFFIRMED.
