In this appeal we are asked to determine whether the district court erred in granting equitable relief to respondent.

Curtis Park Manor is a subdivision of approximately 257 half-acre lots in Northwest Las Vegas. In 1957, 1958 and 1960, Alfred Swartz, as president of Curtis Park Manor Water Users Association (hereinafter "Association"), received three temporary well permits to serve a total of 145 lots in the subdivision.
