Appellant was charged in a two-count information. Count I was for Murder and Count II was for Attempted Murder. Later an additional information charging appellant with Confinement was filed. Appellant was tried before the bench and was found guilty of Murder and Confinement. As to Count II, the Attempted Murder count, he was found guilty of the lesser included offense of Criminal Recklessness. Appellant was sentenced to a forty year term of imprisonment...
