MEMORANDUM

FILIPPINE, District Judge.

These consolidated cases are before the Court on remand from the United States Court of Appeals for the Eighth Circuit. The Court of Appeals directed this Court to hold a hearing on the issue of whether or not the plaintiff's attempt to take the lands in question in fee comes reasonably within the language of the Congressional authorization of the Clarence Cannon Dam and Reservoir project.1
