MEMORANDUM OPINION AND ORDER

ASPEN, District Judge:

On January 18, 1982, Ronald Tonaldi ("Tonaldi") filed a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254, seeking review in this Court of his state conviction for possession of more than 30 grams of cocaine. The conviction was affirmed by the Appellate Court of Illinois in People v. Tonaldi, 98 Ill.App.3d 528, 54 Ill.Dec. 297,
