This is an action for damages based in contract. Jurisdiction is predicated on diversity of citizenship and amount in controversy pursuant to 28 U.S.C. § 1332.

Before the Court are cross motions for summary judgment. It appears that there are no genuine issues of material fact concerning liability. Defendant's motion for summary judgment is denied, and plaintiff's motion for summary judgment is granted...
