On December 4, 1980, defendant entered a plea of guilty to the first count of an indictment charging him with criminal possession of a controlled substance in the fourth degree, a class C felony, in full satisfaction of a four-count indictment. He was sentenced as a predicate felon to an indeterminate 5- to 10-year term of imprisonment.
