In April, 1979, appellee leased a residence and one-half acre site located in an R-20 (residential, single family) zoning district. Shortly thereafter, she filed an application for a land use permit to use the property as a child care center. The county commissioners rejected the application and, in August, 1979, sought an injunction to prevent appellee from using the property as a day care center.
