Plaintiffs-appellants, Mr. and Mrs. Jeffers, appeal from the district court's third grant of summary judgment in favor of defendant-appellee, Betty Doel Martinez. The issue in this case is whether the district court erred in granting the motion for summary judgment because genuine issues of material fact exist.
