On February 13, 1977, Leomie Warmsley (hereafter plaintiff), a 43-year-old housewife, was seriously injured while riding as a passenger in a vehicle driven by her husband, when the vehicle crashed into a railroad support post on Atlantic Avenue in Brooklyn, New York, as a result of a defect in the street.
