Each defendant was indicted on three charges of aggravated rape (G.L.c. 265, § 22) and one charge of kidnapping (G.L.c. 265, § 26). A jury acquitted the defendants of kidnapping and convicted them of so much of each of the remaining three indictments as charged the lesser included offense of rape without aggravation.
