Appellant was indicted for felony escape from lawful confinement while serving a nine-year sentence for burglary and aggravated assault of a police officer. He entered a plea of not guilty and was brought to trial before a jury. The state presented evidence of the circumstances of the escape and appellant was identified as one of the escapees.
