All of the above-entitled proceedings present a common issue on this appeal. Petitioners were former New York City Police officers and members of the police department pension plan. At various times between 1955 and 1964, and before the State "takeover" of the court system, they switched their employment and became court officers and members of the New York City Retirement System.
