Judgment modified, on the law, by reducing the kidnapping in the second degree conviction to one of unlawful imprisonment in the first degree and vacating the sentence imposed thereon. As so modified, judgment affirmed and case remitted to Criminal Term for resentencing and for further proceedings in accordance herewith.
