Plaintiff commenced this action seeking a declaratory judgment that N.Y. Ins. Law § 675.2 (McKinney's 1981) is unconstitutional in that it violates the Equal Protection Clause. Defendants move to dismiss the complaint, and plaintiff cross-moves for summary judgment.
