This is a diversity action by the plaintiff, Sandra Townsend, for the wrongful death of her husband allegedly resulting from medical malpractice. The deceased was admitted to Mercy Medical Center on September 14, 1979 and underwent the surgical removal of his left kidney by the defendant Kiracoff on September 20, 1979.
