On April 4, 1981, appellant William R. DeJarnette, Jr., was riding as a passenger on a motorcycle owned and operated by Timothy James Smith. The motorcycle went out of control and overturned, causing injuries to DeJarnette, with consequent medical expenses and loss of earnings.
