This is an appeal of two summary judgments issued by the District Court of the Eighteenth Judicial District, Gallatin County.

Respondent, Larry Joe Hillard, is the son of respondent, Larry Hillard. In March 1979 the son sold a hotel in Three Forks, Montana, to appellant, Roger Jenkins.
