OPINION

McCORMICK, Judge.

This is an application for a writ of habeas corpus filed pursuant to Article 11.07, V.A. C.C.P.

In 1973, petitioner was convicted of murder with malice and the jury assessed punishment at 5,000 years. Prior to petitioner's trial, a jury found him competent to stand trial. On January 23, 1980, this Court considered petitioner's writ of habeas corpus and ordered that a retrospective competence hearing be held.
