MEMORANDUM OPINION

HUGH GIBSON, District Judge.

At approximately 4:00 a. m. on October 13, 1978, the S/T LADY MARGARET caught fire and burned while on the ways at the Seabrook Shipyard in Seabrook, Texas. At the time of the fire, the captain, George Bosarge, and a fellow crewmember, Gerald Douglas Davis, were on board. Bosarge, asleep in his cabin, awoke to find his room engulfed in flames. He managed to escape with his life, but in so doing suffered second...
