Appellant, Donald Michael Moore, was convicted in the Criminal Court of Shelby County, Tennessee, of murder in the first degree and was sentenced to death. Subsequent to the trial he voluntarily withdrew a motion for new trial which had been filed on his behalf and sought only the statutory review of the death sentence in this Court provided in T.C.A. § 39-2406(a).
