This case concerns the application of the Employee Retirement Income Security Act (ERISA), 29 U.S.C. §§ 1001 et seq., upon the termination of a retirement pension plan. The Plan was established in 1970 under a collective bargaining agreement between appellant Defoe Shipbuilding Co. and Local 49 of the Industrial Union of Marine and Shipbuilding Workers of America.
