MEMORANDUM RULING

STAGG, District Judge.

On September 2, 1980, defendants filed a motion to dismiss, asserting that plaintiff had failed to state a claim upon which relief could be granted. A review of plaintiff's complaint, filed June 26, 1980, reveals that plaintiff held a mortgage on certain immovable property owned by Mr. George Upton in Caddo Parish, Louisiana. Mr. Upton eventually defaulted on the debt secured by the mortgage, and the Bank foreclosed...
