Defendant was convicted of two misdemeanor counts for violating the Wayne County Air Pollution Control Regulation (hereinafter the regulation).1 The first conviction was based on defendant's failure to obtain a certificate of operation from the Wayne County Department of Health prior to running a rotary furnace in violation of § 4.10 of the regulation.
