The defendant, Patricia Johnson, was indicted for malicious wounding and was convicted of the lesser included offense of unlawful wounding in the Circuit Court of Clay County. She was sentenced to one to five years imprisonment, and subsequent to the circuit court's denial of her motion to set aside the verdict and award a new trial, prosecuted this appeal.
