This cause came to be heard on October 22, 1981, at which time neither party presented any evidence, it appearing that all material facts are brought forward in the record of state court proceedings. Petitioner, an inmate at the Tennessee State Penitentiary, was committed to the penitentiary to serve a term of 10 years upon being convicted of armed robbery.
