This is a deceptive trade practice case which presents first, the question of whether there was a waiver of the completion date in the parties' contract and secondly, whether written notice was given of the consumers' complaint before suit was filed as provided in Section 17.50(a) of the Business and Commerce Code as it existed in 1978.
