SCOTT, Judge:
On September 5, 1980, respondent filed a motion to dismiss the above-entitled case for lack of jurisdiction on the ground that the petition was not filed with the Tax Court within 90 days from the date of the mailing of the notice of deficiency as required by section 6213(a), I.R.C. 1954.
