This matter comes before the court on defendants' motions to dismiss. For the reasons stated below, those motions are denied.

These two lawsuits (among others) arose from the pollution of Lake Michigan and the fouling of many Chicago public beaches last summer. Both complaints allege that the City of Hammond and the Sanitary District of Hammond (collectively, "Hammond") discharged large quantities...
