MERHIGE, District Judge.

Plaintiff, a citizen of Virginia, brings this products liability action against the manufacturers of certain power shovels to recover for various respiratory diseases and hearing loss allegedly sustained during plaintiff's operation and maintenance of the machines.

Jurisdiction vests in this Court pursuant to 28 U.S.C. § 1332.
