Defendant was convicted of 18 violations of the Michigan railroad obstruction statute, MCL 466.23; MSA 22.281(1), after a non-jury trial in the 14th District Court on June 8, 1978. Defendant's motion for a new trial was denied. Defendant appealed by right to the Washtenaw County Circuit Court, which reversed and remanded the case in an order dated August 23, 1979.
