HILL, Justice.

Plaintiff Moses brought an action to recover a real estate commission from defendants Claude and Mariette Gagne and damages for the tortious interference with plaintiff's contractual relationships by defendant Peterson. The case was tried by court. Based on findings of fact and conclusions of law the court rendered judgment for defendants.

Defendant Claude Gagne owned jointly with his wife Mariette property designated
