On January 26, 1980, George Kirby was struck by a vehicle operated by Michael Johnson while he was walking on a sidewalk in the Borough of Shippensburg. At the time of the incident, Johnson was an insured of Federal Kemper Insurance Company (hereinafter Kemper).
