This appeal arises out of two different provisions of a separation agreement. In the first suit (the family division action), the plaintiff Nancy C. Hayes sued the defendant Bruce S. Beresford in order to have the support payments of the separation agreement modified. In the second suit (the civil division action), the plaintiff sued the defendant in order to collect arrearages alleged to be due and unpaid under the terms of the separation agreement. The...
