This abandonment case arose as a result of a warrant issued on the basis of an affidavit made by Judy Burgener. The warrant was dated March 5, 1979, and alleged that on November 21, 1976, appellant Foster abandoned his illegitimate child — Richard Eric Burgener, age 2.
