WAITES v. STATE

No. 79-2447.

407 So.2d 299 (1981)

Jeffrey C. WAITES, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Fourth District.

December 14, 1981.

Attorney(s) appearing for the Case

Richard L. Jorandby, Public Defender, Tatjana Ostapoff, Asst. Public Defender, and Peter Birch, Legal Intern, West Palm Beach, for appellant.

Jim Smith, Atty. Gen., Tallahassee, and Stewart J. Bellus, Asst. Atty. Gen., West Palm Beach, for appellee.

The sentence, however, is illegal for two reasons: (1) it exceeds the maximum period provided by law and (2) it contravenes defendant's entitlement to youthful offender treatment. Accordingly, we affirm the conviction but reverse the sentence and remand for resentencing.
