This appeal arises out of demands for partition by licitation of certain property owned in indivision by the parties. Included, within the property in question, are both property acquired by inheritance and by purchase.

In 1959, Joseph Pasternack sold two parcels of property to his two children, Joe, Jr., and Betty. The ownership of those two parcels was purchased in indivision by the latter.
