Holmes and James Beardslee, defendants below, appeal to this court from their convictions and sentences by the District Court of Lancaster County, Nebraska, for the offense of conspiracy to possess marijuana with the intent to deliver, in violation of Neb.Rev.Stat. § 28-4,129 (Reissue 1975) (repealed 1979).
