Defendant, Percy Banks, was charged by indictment with murder and armed robbery. (Ill. Rev. Stat. 1977, ch. 38, pars. 9-1, 18-2.) In a jury trial defendant was found guilty of murder and not guilty of armed robbery and was sentenced to serve 30 years in the Department of Corrections. On appeal defendant contends that he was not proven guilty beyond a reasonable doubt, that he was prejudiced...
