The defaulting executory vendees of improved residential property located in the District of Columbia brought suit against the vendors for the recovery of a $5,000 deposit. The court (Mitchell, J.) granted the plaintiffs' motion for summary judgment, finding that the vendors had failed to forfeit the deposit under an option contained in the contract of sale.
