In this case the appellant, Ralph Smith, was tried before President Judge Brominski and a jury. He was convicted of theft by unlawful taking of a CB radio and conspiracy with respect to that offense, robbery and theft by unlawful taking, receiving stolen property, criminal conspiracy and conspiracy to commit arson.
