This is a medical malpractice action, jurisdiction of which is based on diversity of citizenship. Currently being considered by the court is defendants' motion seeking either a dismissal of the action or, in the alternative, that the court make available the procedures for panel review of medical malpractice cases that is mandated by New Jersey Court Rule 4:21. The court does not feel that it would be appropriate to dismiss...
