On April 7, 1980 appellant-defendant, the Travelers Insurance Company, issued a check in the amount of $523.61 to appellee-plaintiff, William L. King, in payment of a collision loss under a contract of automobile insurance issued by appellant to appellee. Subsequently, appellant insurance company stopped payment on the check.
