Under an indictment charging murder in the first degree appellant was convicted of murder in the second degree and the jury fixed his punishment at twenty-five years in the penitentiary. In the presence of his attorney at arraignment appellant waived reading of the indictment and pleaded not guilty. After sentence was imposed he gave notice of appeal.
